BAKER, J.

This is an appeal from a decision of the Industrial Commission awarding compensation to Isadore J. Lewis, III (claimant), for injuries incurred while being transported from his home to work by his employer, Boyd’s Roofing Company, Inc. (employer). The award sustained the finding of the deputy commissioner.

The employer alleges that the claim is barred by the holding in Kent v. Virginia-Carolina Chemical Co., 143 Va. 62, 129 S.E. 330 (1925). At page 66 of Kent, the Supreme Court stated that “an employee going to or from the place where his work is to be performed is not engaged…
