—Order, Supreme Court, New York County (Richard Lowe, III, J.), entered January 14, 1998, which granted defendant’s motion for dismissal of the complaint in its entirety, unanimously affirmed, without costs.

Based solely on an analysis of “whether the facts as alleged fit within any cognizable legal theory” (Leon v Martinez, 84 NY2d 83, 87-88; see also, Wiener v Lazard Freres & Co., 241 AD2d 114, 120), we agree with the motion court that the complaint fails to state a claim for which relief can be granted.
