Plaintiff, as a mortgage creditor of defendants, upon their default at the maturity of the obligation, caused executory process to issue against the mortgaged property, which was seized, advertised, and sold. Prior to the sale Leon Boudreaux, one of the defendants, filed an intervention and third opposition, claiming a homestead on a portion of the' property seized, and praying for a separate appraisement and sale thereof.
