In a.n action for a declaratory judgment and related injunctive relief, defendant Town of Hempstead appeals from so much of an order and judgment (one paper) of the Supreme Court, Nassau County, dated July 8, 1965, which granted plaintiff’s motion for summary judgment, denied defendant’s cross motion for the same relief, made declarations in plaintiff’s favor and granted an injunction against defendant.
