Appellate Division of the Supreme Court of the State of New York
Appeal by the Board of Education of the City of New York from an order of the Supreme Court, made at the Kings County Special Term and entered in the office of the clerk of the county of Kings on the 14th day of December, 1900, directing said board to pay to the respondents certain moneys, withheld from the award made to property owners with which to pay taxes for the year 1900.

Sewell, J.:
The commissioners of estimate filed their preliminary transcript of estimate on August 27, 1900, by which they awarded the sum of $92,000 for the loss and damage to the respective owners of said *259land, “'subject to the lien of all unpaid taxes, assessments and water rates.”
The commissioners made their report, which was confirmed September 25, 1900.
