Appeal by the defendants, Charles A. Brassier and another, from an interlocutory judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of Hew York on the 22d day of March, 1905, upon the decision of the court, rendered after a trial at the Hew York Special Term, overruling the defendants’ demurrer to the complaint.

McLaughlin, J.:

This action was brought to recover damages for an alleged libel. The publication complained of was a statement in the form of a letter written by the defendant Brassier to and published by the defendant publishing company. The letter is set out in full in the amended complaint and is to the effect that the defendant Brassier • had learned that the plaintiff had issued a circular soliciting subscriptions for an unprinted book, a translation of a German work, *178which he called the “ Swiss Watch Repairer,” and by reason thereof the writer begged to state that he obtained the…
