Appeal from a judgment of the County Court of Tompkins County (Sherman, J.), rendered December 19, 1997, upon a verdict convicting defendant of the crime of criminal possession of a weapon in the third degree.
Pursuant to a joint investigation between the City of Ithaca Police Department and the State Police, defendant’s residence in the City of Ithaca, Tompkins County, was searched on January 24, 1997 during which a nine-millimeter handgun and magazine containing seven rounds of ammunition were located inside a backpack in a second floor bedroom.
