Appeal by people from, judgment of general term, reversing conviction for violating excise law.

The defendant was convicted in the court of special sessions of the city of New York upon a complaint charging him with a misdemeanor in offering and exposing for sale strong and spirituous liquors on a Sunday, in violation of the provisions of the excise law. The statute enacts that any “ person who, whether having a license or not, shall sell, or offer or expose for sale, or give away any strong or spirituous liquors, wines, ale or beer: 1. On Sunday, * * * shall be guilty of a misdemeanor.” The trial was had before the court, composed of three members,-without a jury. The defendant was…
