This action is brought to recover of the-defendant damages for operating a commercial railroad, consisting of freight traffic as well as passenger traffic, along Franklin Avenue in the town of Gastonia, upon which the plaintiff lives in a house owned by him on a lot abutting upon the said avenue. The defendant operates a street ear line of the city of Gastonia. The defendant also operates freight trains and interurban-passenger trains over this avenue in front of plaintiff’s house.
