This case asks us once again to examine the scope of section 1 of the Patent Act, 35 U.S.C. § 101 (1994). The United States District Court for the District of Delaware granted summary judgment to Excel Communications, Inc., Excel Communications Marketing, Inc., and Excel Telecommunications, Inc. (collectively “Excel”), holding U.S. Patent No. 5,333,184 (the 184 patent) invalid under § 101 for failure to claim statutory subject matter. See AT&T Corp. v.
