Goodkich, P. J.:

The plaintiff is a substituted trustee under the will of Caroline II. Stanard, deceased, and the defendants constitute all the persons who claim to be interested in her estate. The parties have submit? ted to this court the determination of a controversy as-to the construction of a part of the 2d paragraph of the will of Mrs. Stanard, dated in 1856, which reads as follows : “ To my beloved son John Beverly Stanard I give and bequeath one-third of my estate, real and personal, bonds, stocks and funds invested, for his use, benefit and profit, for the term of his natural life ;…
