Appeal from that part of an order of the Supreme Court (McNamara, J.), entered June 6, 2002 in Albany County, which, inter alia, granted a cross motion by defendant Donna M. Dietz for summary judgment dismissing the complaint against her.
In December 1997, defendant Donna M. Dietz, the president and owner of defendant Emizack, LLC, signed a five-year lease on behalf of Emizack for space in a shopping center owned by plaintiff in the Town of Guilderland, Albany County.
