The defendant, Richard Boswell, indicted for the murder of his wife, was tried by a jury, foung guilty as charged and sentenced to be hung. He has appealed.

He urges that during the trial of the ease and after the testimony of the defendant for the defendant, except for the right reserved to introduce rebuttal evidence was closed, the judge a quo improperly refused to permit the defendant to rebut certain evidence subsequently introduced by the State, which he claims to have been new evidence.
