Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Sullivan County) to review a determination of respondent which found petitioner guilty of incompetency and terminated his employment.

In 2003, respondent presented a notice of discipline to petitioner, then a correction officer at the Sullivan County Jail, charging him with incompetence for failing to secure and lock the door to a housing block in the jail.
