MEMORANDUM OF DECISION

READY, Chief Judge.

The court has before it the motion of defendant National Security Fire & Casualty Company (National Security), and the cross-motion of plaintiff Gerald Michael and intervenor North Mississippi Savings & Loan Association (NMSL) for summary judgment, both motions agreeing that there is no genuine issue as to any material fact and asserting that each party is entitled to judgment as a matter of law.
