Appeal from a judgment of the Monroe County Court (Frank P. Geraci, Jr., J.), rendered July 28, 2003. The judgment convicted defendant, upon a jury verdict, of murder in the first degree, murder in the second degree (two counts) and arson in the second degree.

It is hereby ordered that the judgment so appealed from be and the same hereby is unanimously modified on the law by reversing that part convicting defendant of murder in the second degree under count two of the indictment and dismissing that *1173count of the indictment and as modified the judgment is affirmed.
