OPINION

KLINGEMAN, Justice.

Chester R. West appeals from a judgment canceling a deed of trust and deed signed by appellee, William N. Cotter, to West, conveying a tract of one hundred (100) acres of land in Wilson County, Texas, owned by Cotter, and awarding Cotter $940.00 in actual damages and $10,000 exemplary damages. Trial was to a jury who in answer to the special issues here involved found that: (1) on the dates when the deed of trust and deed in question were executed by William Cotter he did not have sufficient mental capacity to understand the nature and effect of such instruments and…
