Plaintiff Dow City Cemetery Association filed a breach of contract action against defendant Defiance State Bank after it discovered that its secretary/treasurer had embezzled more than $59,000 through wrongful transfers and withdrawals of funds from accounts held at defendant bank. Plaintiff asserted that the bank breached its contracts with plaintiff by allegedly allowing plaintiffs secretary/treasurer to make transfers and withdrawal of funds from the accounts without the required number of signatures necessary to make a transfer or withdrawal of funds.
