BUFFINGTON, Circuit Judge.
This is an appeal by the Western Union Telegraph Company from a decree dismissing a bill in equity filed by it against Folhemus and others, praying for an injunction to prevent the cutting down of certain telegraph line poles on a public road in New Jersey. The road in question is known as the “Old York Road,” which antedates the Revolution and is the main highway between Philadelphia and New York.
