V. G. Jones sued the receivers of the Seaboard Airline Eailway for damages which he alleged were caused by the railroad’s negligence in killing one of his mules. The court directed a verdict for the defendants, and the plaintiff excepted to the overruling of his motion for new trial, particularly on the ground that the issue of negligence should have been submitted to the jury. The plaintiff testified that he saw the mule run up a bank and run down the bank right in front of the train about 33 or 34 steps north of a crossing; that the mule ran down the embankment, which was between the tracks…
