Proceeding pursuant to section 298 of the Executive Law to review an order of the New York State Human Rights Appeal Board, dated October 4, 1979, which affirmed a determination of the New York State Division of Human Rights, dated December 28, 1978, which dismissed petitioner’s complaint on the ground that there was no probable cause to believe that the Yonkers Racing Corporation and certain of its officers had engaged in an unlawful discriminatory practice.
