delivering the opinion of the court:

The first question to consider is whether this court can review on a writ of error the refusal of the court below at the close of the State’s primary case to direct a verdict for Garboctowski, the plaintiff in error.

Section 12 of Article 4 of the Constitution of 1897 provides that the Supreme Court shall have jurisdiction to issue writs of error to the Court of General Sessions in certain cases “and to determine finally all matters in error in the judgments and proceedings of said * * * Court of General Sessions in such cases,” etc. The same…
