BETTS, District Judge.

The brig Delta was captured on the 2Sth of October. 1861, while attempting to enter the blockaded port of Galveston, in Texas, by the United States ship-of-war Santee, commanded by Commodore Henry Eagle, and sent to the port of New York for adjudication. A libel was filed in this court, containing the usual aver-ments of the captare as lawful prize of war. and praying for a decree of condemnation of the vessel and cargo, on the 27th of November, 1861.
