Petitioner, James Thompson, was convicted in the recorder's court of the city of Birmingham for a violation of a certain ordinance of said city. A fine was imposed upon him, and, in addition thereto, he was sentenced to serve a term of hard labor for the city. From the judgment of conviction he appealed to the circuit court of Jefferson county. The judgment of the recorder's court was in all things regular and valid, and the appeal was duly perfected.
