Complaint for land. Before Judge Edwards. Douglas superior court. October 21, 1907. W. A. Leathers brought an action against Mrs. Mary Leathers, to recover certain lots of land in Douglas county. He alleges that he has title to the land in dispute, being seized thereof in fee; that the defendant is in possession; that she has received the rents and profits from said land since January 1, 1902, of the yearly value of $150; and that she refuses to deliver the property.

1. In her motion for a new trial the plaintiff in error complains of the overruling, by the court below, of a motion for a continuance, which was submitted when the case was called for trial. But it does not appear, upon an examination of the evidence relied upon to support the motion, that the court abused its discretion in refusing the continuance.
