There are certain facts that are undisputed in this record. It is admitted that the town property, known as lot 2 in block 7 in the original town of Oxford Junction, Jones county, Iowa, was exempt as a homestead.

John F. Miller died intestate on the 12th day of January, 1930, seized of 160 acres of land in Cedar county, Iowa, and 357 acres of land in Jones county, Iowa. For a number of years prior to his death, and commencing in 1912, he occupied the homestead property in Oxford Junction, Iowa. Mrs. Miller died in 1924.
