The opinion of the Court was delivered by

Todd, J.

The defendant was indicted for murder, tried and convicted of manslaughter and sentenced to eight years imprisonment at hard labor and has appealed.

He presents several reasons why the sentence should be reversed, only one of which we deem it necessary to notice.

In Ms motion in arrest of judgment, among other grounds in support of it, the accused averred that the offense, of which he was convicted, was .prescribed.
