Appeal by the defendant, The Empire City Fire Insurance' Company, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of New York on the 28th day of February, 1906, upon the verdict of a jury rendered by direction of the court after a trial at the'New York Trial Term.

The action is brought upon a policy of fire insurance issued by the defendant to the Arlington Company (the plaintiff) and the Arlington Collar and Cuff Company, as interest may appear, loss, if any, to be adjusted with and payable to the Arlington Company. That company was the owner of a large plant used in the manufacture of pyralin, a substitute for celluloid goods, at Arlington, Hudson county, N. J.
