WADE, Justice.

I dissent.

The facts as stated in the prevailing opinion, though very meager, are in accordance with my understanding of the evidence. However, some additional facts are necessary to understand my contentions.

The collision occurred about 11 o’clock at night on October 8, 1954, at the intersection of the South Draper Road at 13800 South and State Street, or U. S. Highway 91, the main through highway approaching Salt Lake City from the south. State Street at that point is a four-lane highway.
