Thomas Fitzpatrick, Edward Oenning and Joseph Kennedy (hereinafter called the defendants) were indicted in the criminal court of Cook county for the burning of a building in the city of Chicago. The indictment contained six counts, the first three of which were for arson and the last three for maliciously injuring and defacing a building. The last three counts were waived, the State’s attorney agreeing in open court, during the trial, not to prosecute thereon.
