Scherer v. Merck & Co.

Court of Appeals for the Tenth Circuit

Decided July 9, 2007No. 06-3295Published

1Opinion of the Court

ORDER AND JUDGMENT *

HARRIS L. HARTZ, Circuit Judge.

Charles M. Wilson sought to intervene . as a pro se plaintiff in this action. After the district court dismissed the only claim over which there was federal jurisdiction, it declined to exercise supplemental jurisdiction over the remaining claims and remanded the case to state court. It therefore denied as moot certain pending motions, including Mr. Wilson’s motion to intervene. We dismiss his appeal for lack of jurisdiction.
