*1401Appeal from an order of the Supreme Court, Erie County (Gerald J. Whalen, J.), entered March 3, 2009 in a personal injury action. The order denied defendants’ motion for summary judgment.

It is hereby ordered that the order so appealed from is unanimously affirmed without costs.

Memorandum: Plaintiff commenced this action seeking damages for injuries sustained by her daughter when she was struck at an intersection by a vehicle operated by Kathy L. Messana (defendant).
