MEDINA, Circuit Judge.

In this triple-damage case, based upon an alleged conspiracy or combination among defendants to restrain trade and to monopolize in violation of the antitrust laws, Sections 4 and 16 of the Clayton Act, 15 U.S.C.A. §§ 15, 26; Sections 1 and 2 of the Sherman Act, 15 U.S.C.A. §§ 1, 2, plaintiff appeals from a judgment entered at the close of plaintiff’s ease, dismissing the complaint “on the ground that on the facts and the law plaintiff has shown no right to relief.” As certain counterclaims have not yet been determined, the ease is here by certificate under Fed.Rules…
