Gregory Sherf appeals the judgment of the Circuit Court of Cole County, granting the State of Missouri’s motion for summary judgment on Sherf s attempt to collect from the State Legal Expense Fund. We affirm.
Factual Background
The following facts were stipulated to by the parties and are not disputed on appeal. Gregory Sherf (“Sherf’) filed a claim against Charles Antoniak (“Antoniak”) in the United States District Court for the Western District of Missouri (“federal court”) on April 18, 2008, which was subsequently dismissed without prejudice and re-filed in that same court on May 12, 2005.…
