Appeal from a decree of the Circuit Court of Albemarle county. Decree for plaintiff. Defendant appeals.

(after making the foregoing statement), delivered the opinion of the court.

This is a suit for the specific performance of a contract for the sale of real estate. The contract is set forth in the statement preceding this opinion. There was a demurrer to the original bill, which was sustained by the trial court, with liberty to the complainant to amend. The amendment was made and the bill as amended was demurred to. This latter demurrer was overruled. The parties took evidence pro and con, and submitted the case on its merits, and there was a decree for the specific performance of the contract,…
