Appellant was convicted of illegal possession of marihuana as denounced by KRS 218.020 and fined $200.00 and sentenced to serve two years in the state penitentiary pursuant to KRS 218.210. He contends that: (1) the trial court erred in failing to sustain his motion to quash the search warrant and to suppress the evidence found as a result of the search; (2) the Commonwealth’s evidence failed to establish appellant’s guilt beyond a reasonable doubt and; (3) the Commonwealth’s Attorney’s opening statement of the case and his closing argument to the jury were inflammatory…
