Emma Thompson Smith and others, claiming to he interested in the estate of the decedent, appeared upon the hearing in the proceeding instituted by the administrators for the judicial settlement of their account, though not cited, and claimed the right thus to make themselves parties to the proceeding pursuant to the provision of section 2728 of the Code of Civil Procedure.
