OPINION

Riner, Chief Justice.

This was an action brought in the district court of Laramie County by Marie K. Dudley, plaintiff and respondent against Montgomery Ward and Co., Inc., defendant and appellant, to recover damages for personal injuries which she asserts were sustained when she fell on the floor of defendant’s store. The case was tried by the court with a jury in attendance. There was a verdict for the plaintiff upon which judgment was duly entered.
