(dissenting) : This is an action in the County Court of Greenwood County, upon a policy of insurance upon the life of the plaintiff’s wife, Mattie C. De-Vore, issued December 8, 1924, for $165, payable to the plaintiff. The insured died August 8, 1925. It is admitted that the insured died within 12 months after the insurance of the policy; that she died from chronic.nephritis, inflammation of the kidneys, commonly known as Bright’s Disease, from which, in chronic cases, recoveries are rare.
