OPINION

KELLEHER, Justice.

A Newport County grand jury returned a three-count indictment charging Joseph Medeiros (Medeiros) with the commission of the crimes of murder, burglary, and conspiring with one Antonio Correia (Corr-eia) to commit burglary. On July 1,1986, a Superior Court jury, after a five-day trial, found Medeiros guilty of first-degree felony murder and conspiring to commit burglary. Consequently Medeiros is before us on appeal in which he alleges that the trial justice erred when he denied Medeiros’s motion for a new trial and when he in structed the jury.
