QUARLES, J.

The defendant was arrested about 4:30 P. M., February 11, 1916, when about to leave for Japan on a steamer that was to sail at 5 P. M. on that day. The following morning he was arraigned in the district court of Honolulu and pleaded not guilty to the following charge:

“That Joseph Quni, at Honolulu, City and County of Honolulu, Territory of Hawaii, during one week last past prior to and including the 11th day of February, A. D. 1916, being then and there the father of certain children to wit: Walter Quni and George Quni, of the age of two years and five years,…
