Charged in information filed by the prosecuting attorney with the offense of murder in the first degree alleged to have been committed by unlawfully shooting to death Edward Howard, appellant was by a jury found guilty of murder in the second degree and his punishment was fixed at confinement in the penitentiary for twenty-one years. From judgment in accordance with the verdict appellant prosecutes this appeal.
