This is an action for breach of contract. The original judgment was reversed and the cause remanded by this court in King v. Day, 101 Neb. 346. On a retrial, plain*354tiff recovered a judgment for $4,990.50, from which defendant Appeals.
Defendant was the owner 'of all of the stock of the State Oil Company, a Nebraska corporation, which he sold to plaintiff.
