OPINION
BOURCIER, Justice
This case is before us on the state's appeal from a final judgment of the Superior Court granting Gerald S. Mastraechio’s application for postconviction relief, vacating his previous conviction, and ordering a new trial. The state’s appeal is pursuant to Gen.Laws 1956, § 10-9.1-9.
