The appellant was charged with capital murder and sentenced to life imprisonment. Before trial, the appellant filed a motion for continuance, based on an absent witness, which was denied. On appeal, the appellant claimed that the trial court abused its discretion in denying his motion for continuance. The First Court of Appeals affirmed the appellant’s conviction, holding that the appellant failed to preserve error as to the denial.
