1. The plaintiff in this case, J. H. Jenkins, based .his claim of title to the premises in dispute upon a deed of gift to himself and his mother, alleged to have been duly executed by his grandsire, Noah Ballew, in 1868. At that time the plaintiff was an infant about two years of age. It was shown on the trial that this deed had never been recorded and was lost or destroyed. The plaintiff’s mother, who appeared as a "witness, testified as to its contents, however, and swore unequivocally that the grantor had formally delivered the deed to her in person, and she had “kept it for several…
