During the progress of the receivership of the City Trust Company of Indianapolis, the appellee filed an intervening petition in three paragraphs, in said proceedings, asking for an order and judgment of the court allowing a claim against the insolvent estate of the trust company, and that it be ordered paid by the receiver as a preferred claim. To this petition the appellant filed an answer in three paragraphs, the first paragraph of which was a general denial. There was no reply filed to the second and third paragraphs of answer.
