*90Herman A. Jones, the plaintiff below, filed a suit by notice of motion for judgment against Morris Plan Bank of Portsmouth and G. R. Whitehurst to recover damages for alleged malicious abuse of civil process. The parties will be sometimes referred to as they appeared in the court below.

The defendants filed a plea of the statute of limitations.
