The plaintiffs in error, Charles M. Smith, Sr., Charles M. Smith, Jr., William Woods, Floyd Woods, Benjamin Field, Benjamin Stone, and W. Lee Rodgers, were jointly indicted with James E. Smith and Rex Smith in the court below in 44 counts for violating the provisions of section 5508 of the Revised Statutes [U. S.
