Appeals from (1) an order of the Supreme Court at Special Term, entered August 24, 1972 in Tioga County, which denied defendant’s motion for partial summary judgment to dismiss the plaintiff’s second cause of action, and (2) from a judgment of the Supreme Court in favor of the plaintiff, entered November 21, 1974 in Tioga County, upon a decision of the court at a Trial Term, without a jury.
